These terms are the agreement between you and HumHerd LLC ("HumHerd", "we", "us") for using the HumHerd app and website. Please read them, along with our Health & Safety notice and Privacy Policy. By using HumHerd, you agree to all three.
By opening HumHerd, tapping to begin, or creating an account, you agree to these Terms of Service, our Privacy Policy, and our Health & Safety notice. If you do not agree, please do not use HumHerd. You can use HumHerd as a guest or with an account; these terms apply either way.
HumHerd is for people 13 and older. By using it you confirm you are at least 13. Some social features, such as messaging people you do not already know, may carry a higher age requirement shown at the point of use. If you are using HumHerd on behalf of an organization, you confirm you are authorized to accept these terms for it.
HumHerd includes moving visuals and audio, including binaural and brainwave-style tones. In rare cases moving light or patterns can trigger a seizure, and loud audio can harm hearing. HumHerd is a wellness and creative tool, not a medical device or treatment.
Our Health & Safety notice is part of these terms. By using HumHerd you acknowledge that you have read it and that you use the app at your own risk, using your own judgment about what is safe for your body. Nothing in HumHerd is medical advice, and it is not a substitute for professional care.
You can hum as a guest without an account. If you create an account, you are responsible for keeping your login secure and for activity under it. Tell us at hello@humherd.com if you think your account has been accessed without your permission.

We may remove content or limit or close accounts that break these rules or put other members at risk.
Your music is yours. HumHerd does not claim ownership of the tracks, tones, messages, or other content you create here. You keep your rights in what you make.
Every track you save carries a license you choose (the default is Creative Commons Attribution-ShareAlike 4.0). By making a track public, you allow other members to use it under the license you selected, and you grant HumHerd a worldwide, non-exclusive, royalty-free license to host, store, display, and stream your public content so the app can work, so others can discover and play it, and so it can appear in share previews. You can delete your content, which ends this license going forward, though copies others already saved or shared under your chosen Creative Commons license may remain with them under that license.
You are responsible for the content you share, and you confirm you have the right to share it.
Your music is yours, and every track carries a license you choose. If we ever add paid features around tracks (for example selling, tipping, or licensing tools), HumHerd may charge a platform fee on those transactions. Any such fee would apply only to tracks you explicitly opt into monetizing, never to ownership of your work, and never retroactively.
Some tracks show a "Human-made" mark. This reflects signals that a real person performed the work in the moment. It is honest evidence of live performance, not a guarantee or a verification of anyone's identity. Please read it that way, and see our Human-made explainer for what it does and does not mean.
HumHerd is free to use. Some features are part of a paid subscription. Subscriptions are billed through our payment processor and, on mobile, may be billed through the app store. Paid plans renew automatically until you cancel, and you can cancel at any time; your access continues through the end of the period you already paid for. Except where the law or an app store's rules require otherwise, payments are non-refundable. Prices and features may change, and we will give notice of material changes before they affect you.
How we handle your information is described in our Privacy Policy. In short: we do not sell your data, we do not run ads, and the behavioral signals we use to keep automated accounts out are never sold or shared.
The HumHerd name, look, and software are ours or our licensors'. These terms do not give you rights to our trademarks or to copy the app itself. We may update, change, or discontinue features at any time.
HumHerd relies on service providers for hosting, database, authentication, and payments. Your use of those parts is also subject to their terms, and we are not responsible for third-party services we do not control.
HumHerd is provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the app will be uninterrupted, error-free, secure, or that it will produce any particular result, including any wellness, health, focus, or sleep outcome. Some jurisdictions do not allow certain disclaimers, so some of these may not apply to you.
To the fullest extent allowed by law, HumHerd LLC and its owners, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or relating to your use of HumHerd. To the fullest extent allowed by law, our total liability for any claim relating to HumHerd will not exceed the greater of the amount you paid us in the twelve months before the claim, or fifty U.S. dollars. Some jurisdictions do not allow these limits, so they may not fully apply to you.
You agree to defend and hold harmless HumHerd LLC from claims arising out of content you share, your use of HumHerd, or your breach of these terms, to the extent allowed by law.
You can stop using HumHerd at any time and delete your account from within the app, which cancels any active subscription and removes your data as described in the Privacy Policy. We may suspend or end access if these terms are broken or to protect the service and its members.
We may update these terms as HumHerd grows. When we make material changes, we will update the date at the top and, where appropriate, let you know in the app. Continuing to use HumHerd after a change means you accept the updated terms.
These terms are governed by the laws of the State of Michigan, without regard to its conflict-of-laws rules. If you have a problem, please contact us first at hello@humherd.com so we can try to resolve it informally. Any dispute that cannot be resolved that way will be handled in the state or federal courts located in Michigan, and you agree to that venue, unless the law where you live gives you a right you cannot waive. Nothing here limits any right you have under mandatory consumer-protection laws where you live.
