Terms of Service

These terms are the agreement between you and HumHerd LLC ("HumHerd", "we", "us") for using the HumHerd app and website. Please read them, along with our Community Guidelines, Health & Safety notice, and Privacy Policy. By using HumHerd, you agree to all of them.

1. Accepting these terms

By opening HumHerd, tapping to begin, or creating an account, you agree to these Terms of Service, our Community Guidelines, our Privacy Policy, and our Health & Safety notice. If you do not agree, please do not use HumHerd. You can use HumHerd as a guest or with an account; these terms apply either way.

2. Who can use HumHerd

Guests. Anyone can hum as a guest without an account. Guests can hear and join the shared sound, use the practices, and play the instruments. Guests cannot message people, comment, post notes, or keep a public profile. If you are under 18, use HumHerd as a guest, and only with a parent or guardian's permission.

Accounts are for adults. You must be 18 or older to create or keep a HumHerd account. When you create an account we ask for your birth month and year. Give your real date of birth. We keep only the result of the age check, not the date itself. If we learn that an account belongs to someone under 18, we close it and delete its data. You can tell us about an account you believe belongs to someone under 18 through the report button or at hello@humherd.com.

If you are using HumHerd on behalf of an organization, you confirm you are authorized to accept these terms for it.

3. Health and safety

Our Health & Safety notice is part of these terms. By using HumHerd you acknowledge that you have read it and that you use the app at your own risk, using your own judgment about what is safe for your body. Nothing in HumHerd is medical advice, and it is not a substitute for professional care.

4. Your account and guests

You can hum as a guest without an account. If you create an account, you are responsible for keeping your login secure and for activity under it. Tell us at hello@humherd.com if you think your account has been accessed without your permission.

5. Being a good member

Our Community Guidelines are part of these terms and describe in plain words what is and is not allowed. In short, you agree not to use HumHerd to:

• break the law or infringe anyone's rights, including copyright;
• harass, threaten, hate on, or harm other people;
• sexualize, exploit, groom, or endanger a minor in any way;
• share or threaten to share intimate images of anyone without their consent;
• send sexual content or sexual messages;
• share someone else's personal information without their permission;
• upload or share content that is illegal, or that you do not have the right to share;
• impersonate someone else or misrepresent who or what you are;
• disrupt, overload, scrape, reverse-engineer, or try to break the service or its safety systems, including the systems that discourage automated accounts;
• use the app to build a competing dataset or automated bot network.

We may remove content or limit or close accounts that break these rules or put other members at risk.

6. Messages, reports, and child safety

Accounts can send text messages to people they are friends with or have recently hummed with in a shared room. Messages are text only. You can block anyone, which stops messages in both directions, and you can report any person, sound, room, or note from inside the app.

We do not read messages as a matter of routine. We review content, including messages, when it is reported to us, when we need to investigate abuse or a safety risk, or when the law requires it. A person reviews every report. We may remove content, restrict features, or close accounts as a result.

We do not tolerate child sexual exploitation. We remove it, close the accounts involved, preserve what the law requires, and report apparent child sexual abuse material and the exploitation of children to the National Center for Missing & Exploited Children (NCMEC), which works with law enforcement. If a child is in immediate danger, contact local emergency services first.

7. Removing intimate images shared without consent

If an intimate image or video of you (or of someone you are authorized to act for) appears on HumHerd without consent, including a fake or altered one, email hello@humherd.com with the subject "Removal request", or use the report button and choose "Intimate image without consent". Include:

• a link to, or a description of, where the content appears so we can find it;
• a brief statement that it is of you (or the person you represent) and was shared without consent;
• your physical or electronic signature (typing your full name is fine);
• a way to contact you.

We remove valid requests within 48 hours and make reasonable efforts to remove known copies. A request made in bad faith, or one that knowingly misstates the facts, may itself break these terms.

8. Your content and your rights

Your music is yours. HumHerd does not claim ownership of the tracks, tones, messages, or other content you create here. You keep your rights in what you make.

Every track you save carries a license you choose (the default is Creative Commons Attribution-ShareAlike 4.0). By making a track public, you allow other members to use it under the license you selected, and you grant HumHerd a worldwide, non-exclusive, royalty-free license to host, store, display, and stream your public content so the app can work, so others can discover and play it, and so it can appear in share previews. You can delete your tracks and comments in the app, which ends this license for them going forward, though copies others already saved or shared under your chosen Creative Commons license may remain with them under that license. Tone share links cannot be deleted in the app yet. To remove one, email hello@humherd.com with the link, or delete your account, which removes all of them.

You are responsible for the content you share, and you confirm you have the right to share it.

9. If we ever add paid features around tracks

Your music is yours, and every track carries a license you choose. If we ever add paid features around tracks (for example selling, tipping, or licensing tools), HumHerd may charge a platform fee on those transactions. Any such fee would apply only to tracks you explicitly opt into monetizing, never to ownership of your work, and never retroactively.

10. The Human-made credential

Some tracks show a "Human-made" mark. This reflects live-interaction signals recorded while the track was created in HumHerd. It is evidence of an in-app performance session, not a guarantee of authorship or a verification of anyone's identity. Please read it that way, and see our Human-made explainer for what it does and does not mean.

11. Paid features (Shepherd)

HumHerd is free to use. Some features are part of a paid subscription. Subscriptions are billed through our payment processor and, on mobile, may be billed through the app store. Paid plans renew automatically until you cancel, and you can cancel at any time; your access continues through the end of the period you already paid for. Except where the law or an app store's rules require otherwise, payments are non-refundable. Prices and features may change, and we will give notice of material changes before they affect you.

12. Privacy

How we handle your information is described in our Privacy Policy. In short: we do not sell your data, we do not run ads, and the behavioral signals we use to discourage automated accounts are never sold or used for advertising.

13. Our brand and the app

The HumHerd name, look, and software are ours or our licensors'. These terms do not give you rights to our trademarks or to copy the app itself. We may update, change, or discontinue features at any time.

14. Third-party services

HumHerd relies on service providers for hosting, database, authentication, and payments. Your use of those parts is also subject to their terms, and we are not responsible for third-party services we do not control.

15. Disclaimers

HumHerd is provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the app will be uninterrupted, error-free, secure, or that it will produce any particular result, including any wellness, health, focus, or sleep outcome. Some jurisdictions do not allow certain disclaimers, so some of these may not apply to you.

16. Limitation of liability

To the fullest extent allowed by law, HumHerd LLC and its owners, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or relating to your use of HumHerd. To the fullest extent allowed by law, our total liability for any claim relating to HumHerd will not exceed the greater of the amount you paid us in the twelve months before the claim, or fifty U.S. dollars. Some jurisdictions do not allow these limits, so they may not fully apply to you.

17. Indemnification

You agree to defend and hold harmless HumHerd LLC from claims arising out of content you share, your use of HumHerd, or your breach of these terms, to the extent allowed by law.

18. Ending your use

You can stop using HumHerd at any time and delete your account from within the app, which cancels any subscription billed directly by HumHerd and removes your data as described in the Privacy Policy. Subscriptions billed through an app store must be canceled separately with that app store. Deleting your HumHerd account does not cancel an app store subscription. We may suspend or end access if these terms are broken or to protect the service and its members.

19. Changes to these terms

We may update these terms as HumHerd grows. When we make material changes, we will update the date at the top and, where appropriate, let you know in the app. Continuing to use HumHerd after a change means you accept the updated terms.

20. Governing law and disputes

These terms are governed by the laws of the State of Michigan, without regard to its conflict-of-laws rules. If you have a problem, please contact us first at hello@humherd.com so we can try to resolve it informally. Any dispute that cannot be resolved that way will be handled in the state or federal courts located in Michigan, and you agree to that venue, unless the law where you live gives you a right you cannot waive. Nothing here limits any right you have under mandatory consumer-protection laws where you live.
